Saudi Arabia is a member of the Paris Convention for the Protection of Industrial Property and adheres to the International Classification of Goods and Services (Nice Classification). The Kingdom implemented the GCC Trademarks Law on September 27, 2016, under Royal Decree No. M/51 dated May 26, 2014.

The Saudi Authority for Intellectual Property (SAIP) is the governing body responsible for the registration, enforcement, and protection of trademarks within the Kingdom.

Registration Procedure:

  • Nice Classification: The 12th Edition (2023 version) of the Nice Classification is strictly followed.
  • Separate Applications: Required for each class of goods or services.
  • Non-Registrable Marks: Trademarks related to alcoholic goods, pork products, snuff, and Christmas trees are not registrable.
  • Geographical Indication Rejections: Applications based on geographical indications face frequent rejections by SAIP.

Filing Requirements

  • Notarized Power of Attorney: • Filled with the applicant’s full name and address. • Must be duly Apostilled or legalized up to the Saudi Arabian Consulate (a colored scanned copy suffices).
  • List of Goods/Services: As per the 12th Edition of the Nice Classification (2023 version).
  • Figurative Marks: A soft copy of the mark with a minimum resolution of 200×200 pixels.
  • Priority Claims: Certified copy of the priority application and a certified Arabic translation.

Recordal of change of Name or Address:

  • Notarized Power of Attorney executed by the applicant showing the new name and/or address, duly Apostilled or legalized up to the Saudi Arabian Consulate (a colored scanned copy is sufficient).
  • Certificate of change of name, duly Apostilled or legalized up to the Saudi Arabian Consulate. (For the change of address, this document is not required.)
  • A copy of the TM registration certificate.

Recordal of Assignment/Merger/License Agreement:

  • Notarized Power of Attorney executed by the applicant duly Apostilled or legalized up to the Saudi Arabian Consulate (a colored scanned copy is sufficient.)
  • Notarized Deed of Assignment/Merger document/License agreement (which is applicable), duly Apostilled or legalized up to the Saudi Arabian Consulate.
  • A copy of the TM registration certificate.

Trademark Validity and Renewal:

  • Validity: Trademarks are valid for 10 Hijri years from the application filing date (approximately 9 years and 8 months in the Gregorian calendar).
  • Renewal: A registered mark is renewable for successive periods of 10 Hijri years within the last year of protection. A 6 Hijri month grace period is available for late renewals with late fine.
